SELLING YOUR HOME
We will
- liaise with you and your estate agents, if any,
- work with the buyer’s solicitors,
- obtain your replies to the Law Society Property Information forms and all supporting documentation,
- prepare the legal contract, obtain title documentation from HM Land Registry and send this and supporting documentation to the buyer’s solicitors,
- deal with any enquiries raised by the buyer’s solicitors following their review of the contract pack,
- on satisfying the enquiries raised by the buyer’s solicitors, agreeing dates to exchange contracts and complete the transaction,
- exchange of contracts is where you and the buyer legally commit to the transaction and cannot withdraw without financial consequences. Completion is the moving day, when the money transfers and you hand over your keys,
- obtaining any mortgage redemption statements/drafting final completion statement.
- on completion deal with the redemption of any legal charges (please note the additional charges for the redemption of a Help to Buy Equity loan).
- We aim to achieve this in approximately 12 weeks dependent upon the complexity of your matter and other parties if in a chain. Some types of transactions such as, leasehold flats and shared ownership take much longer and transactions may take longer where unexpected issues arise during the conveyancing process.
BUYING YOUR HOME
We will
- liaise with you and any estate agents, liaise with your lender(s),
- work with the seller’s solicitors,
- receive contract pack and supporting documentation from the seller’s solicitor review and raise any initial enquiries and approve/amend the contract.
- Submit your searches,
- advise you about the results of all searches and consider possible solutions with you if the search results are not as expected,
- investigate the property’s legal title and report to you on the findings
- liaise with you as to timescales and all parties if there is a chain and agreeing dates for exchange of contracts and completion.
- Exchange of contracts is where you and the seller legally commit to the transaction and cannot withdraw without financial consequences. Completion is the moving day, when the money transfers and you collect your keys.
- drafting and approving transfer documents, final accounts and completion statements and request mortgage funds (including certifying to your lender that the title represents good and marketable title and meets their requirements; requesting funds from you in readiness for completion.
- ensuring all the necessary documents are lodged with HM Land Registry following completion.
- Submitting your stamp duty return to HMRC within the required timescales following completion.
- We aim to achieve this in approximately 12 weeks dependent upon the complexity of your matter and other parties depending on if you are in a chain. Some types of transactions such as, leasehold flats and shared ownership take much longer and transactions may take longer where unexpected issues arise during the conveyancing process.
MORTGAGE/RE-MORTGAGE
- Obtaining title documentation from the Land Registry.
- Submitting searches and investigating into title.
- Requesting from you any supporting documentation required following our investigation into title and receiving search results.
- If the transaction is a remortgage, requesting from you, your most recent mortgage statement.
- On satisfying your lender’s requirements of the property representing good and marketable title, requesting mortgage funds.
- Obtaining a redemption statement for any existing mortgage.
- On completion, redeeming any existing mortgage and registering your new mortgage with HM Land Registry.
- We aim to achieve this in approximately 6 weeks.
